General Terms & Conditions by LuxuryIstanbul
- LuxuryIstanbul disclaims any responsibility if/when tours are cancelled if minimum number of passengers is not met. (If Group shared basis tour)
- Prices are subject to change without prior notice.
- Private tours are available every day.
- Discounted rates are valid for guests who make pre-reservation and pre-payment. Reservations upon arrival will be paid from our brochure prices which are higher,
- We kindly request our guests to be ready 10 minutes before departure time,
- Istanbul tour fees include transportation, guide, entrance fees, meals as mentioned and V.A.T.,
- 30% discount for children below the age 7, free for the ages 0-2, in Istanbul City Tours only,
- Courtesy transfer from/to hotels within city for the group tours. Owing to traffic difficulties, pick-ups may delay beyond our control,
- Half day morning tours terminate at Sultanahmet Center, in front of Hagia Sophia,
- Morning pick-ups are between 07:45 - 09:00, afternoon pick-ups are between 12:45 - 14:00.
- Half day morning tours start at 09:00 - 09:15, end approximately at 12:30 - 13:00.
- Half day afternoon tours start at 14:00 - 14:15, end approximately at 17:00.
- Full day tours start at 09:00 - 09:15, end approximately at 17:00,
- No smoking on our tours,
- Cancellation is not possible in the last 24 hours and there will be no refund, even partially. Cancellation is not possible in the last week. There will be no refund for any unused portion of any tour program. For cancellations until the last week, a full refund will be provided less a € 30.- service fee,
- LuxuryIstanbul reserves the right to alter, postpone or cancel the tour without prior notice due to unforeseen circumstances,
- LuxuryIstanbul disclaims any responsibility and shall not pay any indemnity or reimbursement in the event that certain museums or monuments included in the program could not be visited with any reason beyond control,
- LuxuryIstanbul will be under no obligation or liability in case the Bosphorus Tour is to be made, by any reason, with Maritime Lines boat instead of private motorboat of LuxuryIstanbul,
- Guests are to be promptly on time at the meet-points given by the tour guide. Tours will proceed without waiting the delayers,
- Tour programs and prices may change without prior notice.
TERMS & CONDITIONS PAYMENT
We kindly require a deposit payment at the time of booking to secure your reservations. The deposit payment is 35% of the total amount. The remaining 65% of the payment is to be paid on the date you would start the tour. We accept payments by Visa / Master credit cards and bank transfer or by paypal.
If you pay by bank transfer, we will ask you to fax or e-mail the payment receipt. If you pay by credit card, then you will need to fill in the relevant form and send it to us with the documents necessary for identity verification. Luxury Istanbul reserves the right to cancel any booking where the documents have not been received and apply the appropriate cancellation fees.
As soon as we receive the payment, we will start securing your reservations. If any of the proposed accommodations are not available at the time of booking, we will select alternative of a similar standard. A price difference may incur, sometimes more, sometimes less and the balance of the payment will be adjusted accordingly. Availability of the hotels can be checked prior to booking upon request; however no space can be held or guaranteed.
After all your reservations are made and secured, you will receive a confirmed travel itinerary with all services noted along with our local destination management contact details. Upon your arrival in destination, you will receive any further documentation such as vouchers, tickets and/or transfer details essential for your program.
We are not responsible for changes which arise as a result of situations outside of our control, such as technical or maintenance problems with means of transport, changes imposed by rescheduling or cancellation of flights by an airline or main charter, war or threat of war, civil strife, industrial disputes, natural disasters, bad weather or terrorist activity.
All cancellations must be made in writing to LuxuryIstanbul (email@example.com) by email or fax. You or any member of your party may cancel your holiday at any time providing that the cancellation is made in writing by the person who made the original booking and is communicated to us either direct via you or your travel agent. You will receive a refund of the amount paid (excluding any insurance premiums and amendment charge) less the cancellation fees specified below but adjusted (if applicable) for any higher price payable by other members of the group who elect to continue with their booking. Refunds are made only to the original booking office.
No responsibility is taken for cancellations of hotel bookings or any other extra services which have been made directly by the client. You will then be subject to the following cancellation charges:

2-0 days : 100% of selling price
Flight tickets are not included in the above cancellation policy. Once your program is confirmed and flight tickets are purchased, any changes to the dates of the program will incur a change fee or in case of cancellation (this is additional to the service fee). Cancellation fees applied according to the flight companies cancellation policies, Luxury Istanbul do not charge anything extra for the flight ticket cancellations.
If we cancel your holiday: We reserve the right in any circumstances to cancel your holiday. However, in no case will we cancel your holiday less than two months before the scheduled departure date unless it is for reasons outside of our control or for late or non-payment by you. If we have to cancel your holiday (other than for late or non-payment by you) we will offer you either (i) an alternative holiday of comparable type, though if the alternative offered is at additional cost, the difference will payable by you and any ‘No Surcharge Guarantee’ on the original booking will not apply or (ii) a full refund of full moneys paid, in either case being the only recompense which will be due to you.
CONSUMER CLAIMS / COMPLAINTS
We do our very best to ensure that your travel arrangements go according to plan. We endeavor to ensure that all your arrangements run smoothly. However, if you have a complaint arising out of what we have agreed to provide for you please let us know at the earliest opportunity, it is essential and most practical to try to resolve it directly with the local destination management. If a problem arises during your holiday, it is important that you advise the supplier and/or our representatives at the earliest opportunity who will endeavour to put things right. If necessary by calling our Istanbul office from wherever you may be. If you are unhappy with your hotel room, please inform the hotel manager so the situation can be rectified on the spot. If you have an unresolved complaint this should be put to Luxury Istanbul in writing. If your complaints cannot be resolved locally you should advise us within 28 days of the incident, in writing, giving your original reference number and all other relevant information. Your letter will be given prompt attention. If you fail to follow this simple procedure we cannot accept responsibility as we would have been deprived of the opportunity to investigate the matter and hopefully rectify any problem.
The responsibility of LuxuryIstanbul and its affiliated companies is strictly limited. As a tour operator; LuxuryIstanbul organizes, promotes and sells tour programs consisting of certain travel services, including surface/air/water transportation, sightseeing tours, and cruise/hotel accommodations that LuxuryIstanbul purchases or reserves from various suppliers. We exercise every care in the selection of reputable airlines, tour operators, coach operators, hotels and other suppliers of the various travel services used in these tours. It is important to note, therefore, that all bookings with LuxuryIstanbul are subject to the terms and conditions and limitations of liability imposed by airlines, coach operators, hoteliers and other service providers but not limited to shipping, rail, car hire and restaurant operators, whose services we utilize, some of which limit or exclude liability in respect of death, personal injury, delay and loss or damage of baggage.
We always do our best to ensure that your vacation arrangements are satisfactory and we accept liability for, but only to the extent of, any loss or damage sustained by you as the result of our negligence, or that of our employees or agents. However, the company does not accept any liability of whatever nature or the acts, omissions or default whether negligent or otherwise of those airlines, coach operators, shipping and cruise companies, hoteliers or other persons providing services in connection with your tour arrangements pertinent to a contact between themselves and yourselves (which may be evidenced in writing by the issue of a ticket, voucher, coupon or the like) and over which the company has no direct and exclusive control. LuxuryIstanbul does not accept responsibility in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force major or other events which is beyond it’s control, or which are not preventable by reasonable diligence on the part of LuxuryIstanbul, including but not limited to war, civil disturbance, fire, flood, unusually severe whether, acts of God, acts of Government or any other authorities, accidents to, or failure of machinery or equipment or industrial action (whether or not involving our employees and even though such actions may be settled by acceding to the demands of a labor group).
You should familiarize yourself with any health or VISA requirements that may be applicable in the areas that you intend visiting, and you shall be responsible for all entry, exit, health and any other documents required by law, regulations, orders, demands or requirements of the countries visited or transited. You shall carry a valid passport at all times. Passport, VISA and vaccination requirements are not our responsibility and we are not liable for any loss or expense due to your failure to comply with the above. It remains your responsibility to ensure any documents in order and to meet any additional costs incurred (whether by the client or by LuxuryIstanbul on the client’s behalf) as a result of failure to comply with such requirements. You accept that you may be travelling through areas of political, climatic instability, high altitudes and remote areas without proper medical services, and accept the associated risks. The making of a booking constitutes your acceptance of all booking terms and conditions as described herein and forms the basis of your contract with LuxuryIstanbul.
Where travel and health documents are necessary to comply with the requirements of any country you may wish to visit, then it is your responsibility to provide them. If failure to obtain such documents results in fines, surcharges or other financial penalty being imposed upon us then you shall be reimbursed accordingly. You must ensure by consulting your own doctor if necessary of specific health precautions deemed prudent for the country/resort you intend to visit and the appropriate medication/inoculations complied with.
No refund will be due in respect of non-utilisation of any part of the travel arrangements made for you.
We reserve the right in our absolute discretion to terminate your holiday arrangements without notice should your behaviour be such that it is likely in our reasonable opinion to cause distress, damage, annoyance or danger to any other person. In such circumstances, no refund or compensation will be due to you.
Whilst we will make every effort to action any special dietary and/or room requests you may have by passing such request(s) to the hotel or supplier concerned, we will not be liable to you should such request not, in the event, be made available to you.
CONDITIONS OF CARRIAGE / ACCOMMODATION
We are neither a carrier nor a provider of accommodation. Each journey (whether undertaken or not) that you book by land, sea or air is governed by the conditions of the carrier undertaking to provide that carriage. Some of these conditions limit or exclude liability and are often the subject of international agreements. Copies of applicable conditions are available for inspection at the offices of the carrier concerned or through ourselves. It is your own responsibility to reconfirm the onward or return sectors of any air journey with the carrier concerned or such carrier’s duly authorised agent and according to such carrier's regulations. When you book accommodation (whether provided or not) its availability or provision is subject to the ‘House Rules’ of the hotel or other accommodation providing or undertaking to provide such accommodation.
In some circumstances following a natural disaster or political crises, extended services such as coach tours or cruises may be cancelled by the supplier at very short notice, up until several days prior to the date of the service. We stress that this occurs extremely rarely, however in such eventualities LuxuryIstanbul will make every endeavor to offer you substitute arrangements of a similar nature and cost. If the arrangements offered are not acceptable to you, a full refund for the cancelled tour or cruise will be offered. Should the alternative arrangements accepted by you are at a higher cost than that originally charged, the additional cost will be charged by LuxuryIstanbul to your account.
This contract between us and these booking conditions are governed by and construed in accordance with the laws of Turkey. In the case of any dispute between us which cannot be amicably resolved, both yourself and ourselves agree to submit to the exclusive jurisdiction of the Courts of Turkey.
